UPside Mall Privacy Disclosure

This Privacy Disclosure explains the privacy policies of Plastyc Inc. (“Plastyc”) with respect to the operation of the UPside Mall website inclusive of customer communication via phone lines, electronic mail and postal mail services.

Plastyc also operates the UPside Visa® Card programs through other websites. If you are an UPside cardholder, or decide to become one by visiting UPside Card related websites, then you should consult the separate Privacy Policy of such websites, including the MetaBank Privacy Policy which governs the payment transaction services and card issuance services.

We are committed to protecting our customers’ privacy and security. This disclosure explains what information we collect about you, with whom we share it, and how you can direct us not to share certain information with certain parties. This Privacy Disclosure applies to all users of our websites and value-added services, whether they are minor or major.



1. DEFINITIONS

We, our, and us, means Plastyc, the operator of the UPside Mall website.

You and your, means individuals using the UPside Mall website to obtain information about various product and services, including product and services provided by non-affiliated third parties operating independently from Plastyc.

Nonpublic personal information, means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter we will use the term “information” to mean nonpublic personal information as defined by this section.


Affiliate, means a company that Plastyc owns or controls, a company that owns or controls Plastyc, or a company that is owned or controlled by the same company that owns or controls Plastyc. Ownership does not mean complete ownership, but means enough to have control.

Nonaffiliated third party, means a person not employed by Plastyc or a company that is not an affiliate of Plastyc. By way of example, merchants of good and services mentioned inside the UPside Mall pages are non affiliated third parties.

Opt in, means a choice you make to participate in certain optional services, such as, by way of example, receiving a newsletter, which may result in certain sharing and use of your information.

Opt out, means a choice you can make to prevent certain sharing or use of information. We will explain how you can exercise this choice.

2. LIMITATION TO USERS AGED 13 OR HIGHER

We have made it a commercial and operational policy at Plastyc to not knowingly accept any applications or communications from children under the age of 13. We do not knowingly market to or solicit information from children under 13.
We are not responsible for the data collection and practices of nonaffiliated third parties that may be linked to/from our Web site, with respect to compliance with the Children Online Privacy Protection Act (COPPA).

3. INTERNET SAFETY For CHILDREN

The Internet is a public network. Children’s access to the Internet can allow them to visit inappropriate Web sites and be exposed to unwanted risks. Parents can be proactive by installing filtering software that gives them more control over their family’s Internet experience.
We recognize that protecting children’s identities and privacy online is important and that the responsibility to do so rests with both the online industry and with parents. While Plastyc works to protect your personal information, you also have responsibility.

4. INFORMATION COLLECTION & USE

Registration

There is no need to register for using the UPside Mall website. We do not collect registration information from non-registered visitors to this website.

Clicking on product or merchant links on the UPside Mall web pages.

If, during your visit of the UPside Mall website, you choose to click on one of the product or merchant links, your action of clicking will be registered anonymously, i.e. without personally identifiable information, by both our servers and the destination merchant’s servers, for the sole purpose of determining if such selection later results in a purchase by you, and therefore determine the efficiency of the UPside Mall in driving traffic towards its merchants.

If you are an UPside cardholder (or the parent/tutor of record of a minor UPside cardholder), and have logged into an UPside Card website or into the UPside Mall website to identify yourself as such, prior to visiting the UPside Mall website, and you choose to click on one of the product or merchant links, your action will be registered by our servers as related to you as an individual cardholder user (or parent/tutor of record), whereas your action will be recorded anonymously without personally identifiable information by the destination merchant.

We record your action for the sole purpose of being able to grant you loyalty points, should your action be followed up by a purchase by you from the merchant. Such information will not be shared or sold to any third party.

Participation in Surveys or Contests

From time to time we may provide you the opportunity to participate in contests or surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information and demographic information (e.g. zip code)

We use this information to notify contest winners and award prizes to participants to monitor site traffic, and to personalize the site to best fit the needs of our customers. We may use a third party service provider to conduct these surveys or contests; that company is/will be prohibited from using our users’ personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior written notice and choice.

Tell-A-Friend

From time to time, we may provide an email-based referral service allowing you to automatically tell a friend about the UPside Mall site, where we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. Plastyc stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Your friend may contact us at cs@uspidecard.com to request that we remove this information from our database.

Navigating the UPside Mall Website

As is true with most web sites, we gather certain information automatically and store it in log files. This information includes Internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies to track returning users to our site.

We do not link this automatically-collected data to personally identifiable information.

We may use third party tracking services that uses cookies/log files to track non- personally identifiable information about visitors to our site in the aggregate, e.g. usage and volume statistics to analyze trends, to administer this site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

5. CHOICE OPT-IN/OPT-OUT

We may provide you the opportunity to “opt-in” to certain optional services making use of personally identifiable information which we will ask you as part of the opt-in process, such as, by way of example, an UPside Mall alert program or Newsletter offering certain email recommendations about product promotions and recommendations.
Such services are opted into entirely on a voluntary basis.

If you no longer wish to receive our promotional communications or newsletter, you may opt-out of receiving them by following the instructions included in each newsletter or communication.

You will be notified when any third party that is not our agent/service provider collects your personally identifiable information, so you can make an informed choice as to whether or not to share your information with that party.

6. CUSTOMER SERVICE COMMUNICATIONS

We may communicate with you in response to your inquiries and to provide the services you request. We will communicate with you by email or telephone, in accordance with your wishes.

7. INFORMATION SHARING AND DISCLOSURE

Aggregate information (non-personally identifiable)

We may share aggregated demographic information about our user database with our partners and advertisers. This information does not identify individual users.

We do not link aggregate data with personally identifiable information.

Service Providers

We may disclose all of the information we collect, as described above, to companies (including affiliates) that perform services on our behalf, including those who assist us in preparing and mailing promotional communications or newsletters (if applicable) and responding to customer inquiries.

These third parties are prohibited from using your personally identifiable information for any other purpose.

Sharing with affiliates

Although Plastyc currently does not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, "affiliates"), it may in the future. Plastyc may share some of all of your personal information with these affiliates, in which case we will seek to require our affiliates to honor this Privacy Disclosure.

Legal Disclaimer

We reserve the right to disclose your personally identifiable information as required by law and when we believe disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our web site.

8. ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION

If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, deactivate or delete it by emailing customer support through our secure Contact Us link at the bottom of each website page.

9. SECURITY

We restrict access to nonpublic personal information about you to our employees who have a need to know such information (e.g., to process your customer support requests). We train our employees on the importance of customer privacy and confidentiality. We also maintain physical, electronic, and procedural safeguards that comply with federal standards to guard the nonpublic personal information of our customers.

Although we follow generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it, no method of transmission over the Internet or method of electronic storage is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personally identifiable information, we cannot guarantee its absolute security.

10. SPECIAL NOTICE FOR CALIFORNIA RESIDENTS

In order to comply with California law, if our records with respect to you indicate a California address we will not disclose information that we have about you outside of our family of companies, unless otherwise permitted by law.

11. SPECIAL NOTICE FOR VERMONT RESIDENTS

In order to comply with Vermont law, if our records with respect to you indicate a Vermont address we will not disclose nonpublic personal financial information about you to nonaffiliated third parties, other than permitted by law, unless you authorize us to make that disclosure. Your authorization must be in writing or, if you agree, in electronic form. If we disclose information about you to nonaffiliated third parties with whom we have joint marketing agreements, we will only share information about your name, contact information, and our own transactions and experiences with you.

12. BUSINESS TRANSITIONS

In the event Plastyc, Inc. And Plastyc.com go through a business transition, such as a merger, acquisition by another company, or a sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred. You will be notified via email and by a prominent notice on our web site of any change in ownership or control of your personally identifiable information.

13. CHANGES IN THIS PRIVACY STATEMENT

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
